Tivexa Terms of Service

Effective 5 November 2026 (updated 5 November 2026). Applies to all TIVEXA games for Android published by 2852483 Alberta Inc. ("Tivexa", "we", "us"), including Sortwise, Signal Garden and future titles listed on our Google Play developer page.

1. Who we are

TIVEXA is the game studio of 2852483 Alberta Inc., 319-1144 Adamson Dr SW, Edmonton, Alberta T6W 2X7, Canada. Contact: admin.tivexa@protonmail.com.

2. Agreement

By downloading or playing a Tivexa game you agree to these terms and to our Privacy Policy (and any game-specific privacy policy linked from its store listing). If you do not agree, do not use the game. Google Play's own terms also apply to downloads made through Google Play.

3. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and play our games on Android devices you own or control, for your own non-commercial entertainment. You may not copy, modify, reverse-engineer, sell, rent or redistribute the games or any of their content, or use them in a way that breaks the law or these terms.

4. Free games and advertising

Our games are free to play and supported by advertising provided by Google AdMob. Some games offer optional rewarded ads that you can choose to watch for an in-game benefit; they are never required to progress. Where your region allows it, you can turn ads off from the game's "Ads and privacy choices" screen. Our games do not sell in-app purchases unless a game's store listing says otherwise.

5. Your progress

Game progress and settings are stored on your device only. We cannot restore progress that is lost through uninstalling, clearing storage, changing device or a device fault.

6. Changes and availability

We may update, change or discontinue a game or any feature at any time, including through app updates. We aim to keep our games working on supported Android versions but do not guarantee uninterrupted availability.

7. Intellectual property

The games, their names, artwork, music, level designs and code are owned by 2852483 Alberta Inc. or its licensors and are protected by copyright and trademark law. Nothing in these terms transfers any ownership to you.

8. Disclaimer of warranties

Our games, this website and any related content are provided "as is" and "as available", with all faults and without warranties or conditions of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy or quiet enjoyment. We do not warrant that a game will be uninterrupted, error-free, secure, free of viruses or other harmful components, compatible with your device, or that defects will be corrected. Any material downloaded or otherwise obtained through a game is at your own discretion and risk.

9. Limitation of liability

To the fullest extent permitted by applicable law, 2852483 Alberta Inc. and its directors, officers, employees, contractors and licensors will not be liable to you for any indirect, incidental, special, exemplary, punitive or consequential damages, or for any loss of data, game progress, profits, revenue, goodwill or use, however caused and under any theory of liability (contract, tort including negligence, strict liability or otherwise), even if we have been advised of the possibility of such damages.

In particular, and to the same extent, we are not liable for: (a) any damage to, or malfunction of, your device, battery, storage or other software, including overheating, wear or reduced performance; (b) loss or corruption of saved progress or settings; (c) data charges, roaming fees or other costs from your carrier or internet provider; (d) the content, availability or data practices of advertisements, app stores, operating systems or other third-party services, including Google Play, Google AdMob and Google's consent tools; (e) any interruption, suspension, removal or discontinuation of a game; (f) unauthorised access to or alteration of your device or data; and (g) any physical, emotional or health effects of play, including eye strain, repetitive-strain injury or effects from flashing or moving imagery. Please take regular breaks and stop playing if you feel discomfort.

If, despite the above, we are found liable to you for any reason, our total aggregate liability for all claims arising out of or relating to a game or these terms will not exceed the greater of (i) the amount you paid us for that game in the 12 months before the claim (which, for our free games, is CAD 0) and (ii) CAD 10. These limitations are a fundamental part of the agreement between us; the games would not be offered free of charge without them.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including for death or personal injury caused by our negligence, or for fraud, and nothing limits rights you have as a consumer under the laws of your country or province that cannot be excluded by agreement. In such cases our liability is limited to the minimum extent permitted by that law.

10. Your responsibilities and indemnity

You are responsible for your device, its security, its settings (including parental controls), and for keeping it and the game updated. You agree to use the games only for lawful purposes and in accordance with these terms and the rules of the app store you obtained them from. To the extent permitted by law, you agree to indemnify and hold harmless 2852483 Alberta Inc. and its directors, officers, employees, contractors and licensors from any claims, losses, damages, liabilities and expenses (including reasonable legal fees) arising out of your breach of these terms, your misuse of a game, or your violation of any law or third-party right.

11. Third-party services

Our games use third-party services, including Google Play for distribution and Google AdMob for advertising. Those services have their own terms and privacy practices, which we do not control and are not responsible for. Advertisements are provided by third parties; we do not endorse, and are not responsible for, any advertised product, service or website, or any transaction you make with an advertiser.

12. Age and eligibility

Our games are intended for players aged 13 and over unless a game's store listing says otherwise. If you are under the age of majority where you live, you may use the games only with the consent and supervision of a parent or legal guardian who agrees to these terms on your behalf.

13. Termination

You may stop using a game at any time by uninstalling it. We may suspend or end your licence if you breach these terms.

14. Governing law and disputes

These terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Subject to any mandatory consumer protections of the country or province where you live, you agree that the courts of Alberta, Canada have exclusive jurisdiction over any dispute arising out of or relating to these terms or the games. Any claim must be brought within one year after it arises, to the extent the law allows such a limit. If any provision of these terms is held invalid or unenforceable, the remaining provisions stay in full force, and the invalid provision will be enforced to the maximum extent permitted. Our failure to enforce any provision is not a waiver of it.

15. Changes to these terms

We may update these terms from time to time. The effective date above shows the latest version; material changes will be reflected here and, where appropriate, in the game or its store listing.
